On January 27, 2020, the Court issued an order granting final approval of a settlement in the amount of $1,812,500 in Robert Grayer and Brian Morton v. Kennametal, Inc., U.S. Dist. Ct. N.D. Ohio No, 1:16-CV-01382. Attorneys Richard T. Bush of Green Haines Sgambati Co., L.P.A. and Chastity Christy of the Lazzarro Law Firm, LLC were class counsel in this collective/class action for unpaid overtime resulting from Kennametal’s institution of a 20 minute shift overlap while eliminating pay for a 20 minute break period. Kennametal vigorously denied liability, arguing that federal law permitted exclusion of break time. After three and one-half years of hard fought litigation Kennametal continued to deny liability while agreeing to a settlement which resulted in distributions on behalf of some 357 hourly employees in amounts equal to 74% of the overtime compensation claimed. Kennametal also discontinued the challenged practices shortly after the lawsuit was filed.
