CHANGE IN ADMINISTRATIVE CODE BENEFITS INJURED WORKERS IN OHIO

A recent change in the Ohio Administrative Code makes it easier for injured workers to obtain diagnostic services in their workers’ compensation claims. This change to section 4123-6-31 became effective June 1, 2024. Prior to the change the section provided that MRI’s, CT scans and x-rays could be performed in allowed claims in order to help identify other conditions which may be relevant to the claim. For instance, if a claim was only allowed for a back sprain but a treating doctor believed there may be a disc issue, they could request these diagnostic tests. These tests could be approved in order to identify more specific conditions. However, injured workers were limited to these services.

The newly revised section expands the services which a medical provider can request and have authorized. Specifically, the Bureau will now approve EMG’s, nerve conduction studies, epidural injections and nerve blocks as diagnostic measures just as they had with MRI’s, CT scans and x-rays. This greatly increases the tools a medical provider has at their disposal to definitively identify the source of their patients’ problems.
